This Privacy Policy explains how Fontaine Associates LLC (“Fontaine,” “we,” “us,” “our”) collects, uses, and shares information when you visit HeyEthan.ai or use our Services.

1) Information We Collect

A) Caller Notice and Consent
When HeyEthan.ai handles calls on behalf of a Customer, the Services may generate AI-created transcripts and call summaries by default as part of delivering the service. These transcripts and summaries are provided to the Customer (our client) for internal business use and may be routed to the Customer’s connected tools based on their configuration. Customers are responsible for determining and implementing any caller notice and consent requirements that apply to their business, jurisdiction, and use of transcription/summarization (and recording, if enabled). Because transcripts and summaries are generated using automated technology, they may contain errors or omissions.


B) Information you provide
When you submit forms, request a setup call, or communicate with us, we may collect:

  • Name, email, phone number
  • Company name, website URL, industry, time zone, preferred contact time
  • Notes/goals you submit
  • Billing/contact details if you become a customer

C) Call and service data (when Services are active)
Depending on your configuration, we may process:

  • Call metadata (time, duration, routing outcome)
  • Call summaries, transcripts, and message details
  • Scheduling and appointment details you choose to capture
  • Configuration details you provide (scripts, FAQs, call flows)

D) Website and device data
We may collect:

  • IP address, browser type, device identifiers
  • Pages visited and interactions on our website
  • Cookies/analytics data (if enabled)

2) How We Use Information

We use information to:

  • Respond to inquiries and schedule setup calls
  • Provide, maintain, and support the Services
  • Configure routing, handoff, scheduling, and integrations
  • Send service-related communications
  • Improve reliability, security, and performance
  • Comply with legal obligations and enforce our Terms

3) SMS Messaging and Consent

Fontaine Associates LLC, operating the HeyEthan.ai service and related demonstration experiences, may send transactional text messages only after an individual provides a mobile telephone number and expressly consents to receive the requested message.

Transactional messages may include secure payment links, reservation or appointment confirmations, changes, cancellations, and other service-related information specifically requested by the recipient. SMS consent is not a condition of purchasing goods or services. Message frequency varies based on the recipient’s requests. Message and data rates may apply.

Recipients may reply STOP to opt out of future text messages or HELP for assistance. Opt-out requests are honored as required by applicable law and carrier rules.

We do not sell or share SMS opt-in data, consent records, or personal information with third parties for their marketing or promotional purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with service providers only as necessary to deliver the requested messaging service, operate our systems, prevent fraud, maintain security, or comply with legal obligations.

4) How We Share Information

We may share information with:

  • Service providers who help us operate the Services (telephony, AI processing, hosting, analytics, email delivery, automation)
  • Integrations you enable (calendar, CRM, Slack/email tools, etc.)
  • Legal/compliance where required (lawful requests, fraud prevention, security incidents)

We do not sell your personal information.

5) Customer Data vs. Website Lead Data

  • If you are visiting our website and submit a form, Fontaine acts as a controller of that information for sales and onboarding purposes.

If you are a paying customer and we process caller/customer data as part of providing the Services, Fontaine may act as a service provider/processor on your behalf, depending on applicable law and your configuration.

6) Data Retention

We retain personal information only for as long as reasonably necessary to provide and support the Services, fulfill the purpose for which the information was collected, maintain required business and legal records, resolve disputes, enforce agreements, and meet security or compliance obligations.

Retention periods may vary depending on the type of information, the Customer’s configuration, enabled integrations, applicable provider settings, and legal requirements. When information is no longer reasonably required, we take appropriate steps to delete, anonymize, or securely dispose of it.

  • Intake form submissions: 24 months
  • Call summaries/transcripts: 60 days
  • Call recordings (if enabled): 60 days

7) Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. No system can be guaranteed 100% secure.

8) Your Choices and Rights

Depending on your location, you may have rights to request:

  • Access to personal information we hold about you
  • Correction or deletion
  • Objections or restrictions in certain circumstances
